Bike Rental Terms And Conditions

The Office of the Consumer Protection Board (OCPB) has declared car and motorcycle rental services as “Controlled Contract Businesses,” effective December 30, 2025

Our terms page includes a prominent compliance notice and that all financial obligations are clearly displayed before booking confirmation.

Rental Eligibility & Requirements

1.1 Age Requirement

  • Minimum age: 20 years depending on motorcycle type and company policy 

  • Renters under 20 may be subject to additional restrictions or deposit requirements

1.2 Required Documents

The following original documents are required at pickup:

  • Valid passport (copies will be made; originals returned) 

  • Valid driver’s license from your home country with motorcycle endorsement

  • International Driving Permit (IDP) with motorcycle certification (required by Thai law for legal operation) 

⚠️ Warning: Insurance coverage is only valid with a proper International Driving Permit that includes motorcycle certification. Without an IDP, renters assume full liability for all damages, injuries, and fines .

1.3 Competency Requirement

Rental companies reserve the right to decline or cancel a rental if, in the reasonable judgment of staff, a rider is not competent to safely operate a motorcycle .

Section 2: Booking, Payment & Deposit

2.1 Payment Terms

  • Full payment of rental fees is required at the start of the rental period 

  • Accepted payment methods: credit/debit card, cash in Thai Baht, or bank transfer 

  • Rental rates are calculated on a 24-hour basis 

2.2 Security Deposit

2.3 Deposit Handling

  • Deposits are held for the duration of the rental period

  • Refunded upon return of motorcycle in same condition as at pickup

  • Deductions may be applied for damages, late return, or unpaid fines

  • Passport deposits: original passport may be required for larger displacement motorcycles 

2. Included Equipment

  • 2 helmets included with each rental 

  • Optional: new helmets available for purchase 

  • Additional gear (jackets, gloves, phone holders) may be available for rent or included depending on company 

2.5 Pricing Structure

  • Prices displayed are per motorcycle for the rental period

  • Daily rental rates based on 24-hour calculation

  • Weekly and monthly rates available with degressive pricing 

  • Fuel not included unless otherwise specified

Section 3: Usage Restrictions

3.1 Prohibited Uses

The rented motorcycle shall NOT be used for:

  • Operation by anyone other than the registered customer 

  • Carrying passengers or property for hire or reward 

  • Towing or pushing anything 

  • Racing, speed testing, or off-road use 

  • Illegal purposes or under influence of alcohol/drugs 

3.2 Geographic Restrictions

  • Riding permitted on good surface roads only 

  • Cross-province or cross-country travel requires prior written consent from rental company 

  • Off-road, beach, and racetrack use strictly prohibited 

3.3 Passenger and Cargo Limits

  • Do not exceed manufacturer’s recommended load capacity

  • Only carry number of passengers legally allowed and specified in rental agreement

Section 4: Insurance & Liability

4.1 Standard Insurance Coverage (Por Ror Bor)

All rentals include basic government insurance with the following limits :

4.2 Insurance Limitations

⚠️ Important Exclusions:

  • Insurance does NOT cover damage to the rented motorcycle 

  • Insurance excludes property damage to third-party property beyond coverage limits 

  • Insurance is void without valid driver’s license and IDP recognized by Thai authorities 

4.3 Optional Protection Available

  • Property Protection (damage coverage for rental bike): ฿300/day with deductible of ฿15,000 per claim 

  • First Class Insurance (comprehensive): available as optional upgrade 

4.4 Liability Disclaimer

Renting and riding a motorcycle is inherently risky. The renter assumes full responsibility for personal injury, loss, or damage. The rental company is not liable for any injuries, damages, or losses resulting from use of the motorcycle

Section 5: Damage, Theft & Fines

5.1 Damage Responsibility

Renters are financially responsible for any damage to the motorcycle beyond normal wear and tear .

Damage assessment process:

  • All existing damages are marked in contract before signing 

  •  
  • New damages assessed using manufacturer parts prices

  • Renter pays cost of replacement parts at lessor’s established prices

5.2 Theft Responsibility

Renters assume full liability for theft or loss of the motorcycle during the rental period .

Theft prevention requirements:

  • Park only in secured parking areas with security systems 

  • Use all security devices fitted to the motorcycle

  • Always lock the motorcycle when unattended 

5.3 Third-Party Liability

Renters are responsible for:

  • Any damage caused to third-party property while operating the motorcycle 

  • Excess damage amounts beyond insurance coverage limits

5.4 Fines and Penalties

Any legal penalties, fines, or fees incurred while riding the motorcycle are the renter’s sole responsibility . This includes:

  • Traffic violations and speeding tickets

  • Parking fines

  • Driving without proper license/IDP

5.5 Late Return Charges

  • Late returns subject to additional charges 

  • Full daily rate applies for each additional day or partial day

  • Early return does not qualify for refund of unused rental period

Section 6: Maintenance & Breakdown

6.1 Company Responsibility

The rental company is responsible for:

  • Engine breakdown not caused by renter (replacement bike provided) 

  • Mechanical failures (company pays for repairs) 

  • Ensuring motorcycle is in satisfactory condition at start of rental 

6.2 Renter Responsibility

The renter is responsible for:

  • Flat tires (renter pays for repair/replacement) 

  • All other damages except engine breakdown 

  • Basic checks every 500 km (oil, coolant, tire pressure, chain tension) for rentals over one week 

  • Using correct fuel and engine oil 

6.3 Accident and Breakdown Procedure

In case of accident, breakdown, or damage:

  1. Notify rental company immediately 

  2. Do not authorize repairs without company permission 

  3. For breakdowns: replacement bike will be arranged if needed 

  4. For accidents: follow local procedures and obtain police report

Section 7: Cancellation & Refund

7.2 Booking Modifications

  • Rental period extensions must be requested prior to expiry of current rental period 

  • Failure to notify extension constitutes infringement 

  • Any booking modifications agreed upon are binding; additional fees may apply 

7.3 Owner/Company Cancellation

If the rental company cancels a confirmed booking, renters receive:

  • Full refund of any amounts paid online

  • The rental company is not liable for additional travel costs or compensation 

7.4 Early Return

  • Returning the motorcycle earlier than the booked end date does NOT qualify for refund

  • Renter is charged the full rental price as originally booked

Section 8: Jurisdiction

8.1 Governing Law

These terms and the rental agreement are governed by and construed in accordance with the laws of Thailand .

8.2 Dispute Resolution

Any disputes arising from the rental agreement shall be subject to the exclusive jurisdiction of Thai courts .

8.3 Indemnification

The renter agrees to indemnify and hold harmless the rental company, its owners, employees, and agents from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees) arising from the renter’s use of the motorcycle

Section 9: Privacy & Data Protection

  • Customer personal information is collected for rental booking and identity verification purposes

  • Information is not shared with third parties except as required for legal compliance or insurance processing

  • By renting, customers consent to the collection and processing of their personal data as described

Section 10: Modifications to Terms

The SCOOTER EXPRESS reserves the right to update or modify these Terms and Conditions at any time. The latest version will be posted on the website. Continued use of services after changes constitutes acceptance of modified terms
