1. These terms

These Terms of Service ("Terms") govern your use of the ScooterExpress website at scooterexpress.co and any motorbike or scooter rental you book through it.

By using the website, creating an account or submitting a booking, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, please do not submit a booking.

Before you confirm a booking, the website asks you to tick a box confirming that you have read and agree to these Terms and acknowledge the Privacy Policy. We record the version you accepted and the time of acceptance with the booking.

The rental agreement you sign or accept at pickup contains the specific details of your rental, including the vehicle, dates, price, deposit and any additional charges. If the rental agreement conflicts with these Terms, the rental agreement controls for that rental.

2. Who can rent

To rent from ScooterExpress you must:

  • be legally able to enter into a binding rental agreement;
  • hold a valid driving licence for the class of motorcycle or scooter you are renting;
  • hold a valid passport or other identification acceptable to us if you are not a Thai resident;
  • hold an International Driving Permit (IDP) where Thai law or the rental agreement requires one for your licence;
  • provide accurate, current and complete information, including your name, contact details, nationality and licence details;
  • be physically able to operate the vehicle safely and lawfully.

Thai law sets the minimum age and licence requirements for riding a motorcycle. We do not publish a different minimum age on this website. At pickup we check your original documents. We may refuse a rental if the documents are missing, expired, altered, do not match the booking, or do not permit you to ride the vehicle lawfully. In that case, the cancellation provisions in section 7 apply.

You must not allow another person to ride the vehicle unless that person is listed on the rental agreement, has been verified by us, and is legally licensed. Sub-renting or lending the vehicle to an unlisted rider is not permitted.

3. Booking and confirmation

The booking process on the website works as follows:

  1. You choose a motorcycle or scooter and select your rental dates.
  2. The website checks availability and calculates the rental price and security deposit.
  3. You enter your contact, licence and rental details. You can create an account or continue as a guest.
  4. You review the booking and accept these Terms and the Privacy Policy.
  5. You submit the booking.
  6. We review the booking and confirm availability. A booking is confirmed only when we send you a confirmation or update its status to confirmed in the customer portal.
  7. Payment is confirmed separately, as described in section 5.

Submitting a booking is a request, not a guarantee that a vehicle is available. Availability can change between the moment you view the calendar and the moment staff review the booking. If we cannot provide the booked vehicle, we will contact you to offer an alternative or cancel the booking under section 7.

You are responsible for checking that the dates, pickup time, bike and contact details in your confirmation are correct. Tell us promptly if anything is wrong.

4. Prices and what you pay

Prices are shown in Thai baht (THB). The booking page shows the rental charge, any add-ons, the security deposit and the total before you confirm. The amount you actually pay is the amount shown in your booking confirmation, subject to any change you and we agree later.

The rental price covers use of the vehicle for the agreed period and the inclusions stated in the booking or rental agreement. It does not cover fuel, traffic fines, tolls, parking charges or other costs you incur during the rental unless we expressly state otherwise.

Additional charges that may apply are described in section 6. We do not add a charge that was not disclosed before you confirmed, unless it arises from something that happens during the rental, such as a late return, damage, a missing item or a traffic fine.

5. Payment

The payment methods available for your booking are shown at checkout before you confirm. Currently the website supports:

  • Cash at pickup: you pay the amount due when you collect the bike. Staff record the payment against your booking.
  • PromptPay QR transfer: when this option is enabled for your booking, the website shows a Thai QR code and a payment reference. You scan it with your bank app and transfer the amount. A member of staff checks the incoming transfer and marks the booking as paid.

Payment is not confirmed automatically. A PromptPay transfer is treated as paid only after our staff verify it and update the booking. An unpaid booking remains pending until payment is verified; if you can no longer complete it, contact us so the dates can be released.

We do not currently accept card payments through this website and do not store complete card details. Do not send card numbers, PINs, one-time passwords or bank passwords by email, WhatsApp or the contact form.

If you pay by PromptPay, use the exact amount and reference shown for your booking. If the amount or reference does not match, verification may be delayed. If you pay by cash, ask for a receipt and check that the booking is marked as paid.

6. Security deposit and additional charges

A refundable security deposit may be required for your rental. The amount is shown at checkout and in your booking confirmation before you pay. The deposit is held to cover unpaid charges, damage beyond normal wear, missing equipment, fuel shortages, late returns, cleaning or traffic fines, as described in the rental agreement.

The deposit is not a rental fee. After the vehicle is returned and inspected, we refund the deposit, less any agreed or properly assessed deductions. If you paid by PromptPay, the refund is normally made by bank transfer to an account you nominate. If you paid in cash, the refund is normally made in cash at the shop unless another method is agreed.

Deductions may include:

  • Late return: the additional rental charge for the extra time, calculated at the applicable rate.
  • Fuel: the cost of replacing fuel so the vehicle is returned at the agreed fuel level.
  • Cleaning: a reasonable cleaning charge if the vehicle is returned in a condition beyond normal use.
  • Damage and repair: the reasonable cost of repairing damage caused during the rental, assessed after inspection. Normal wear and tear is not charged.
  • Missing equipment: the replacement cost of keys, helmets, phone holders, documents or other items that are not returned.
  • Fines and penalties: traffic or parking fines attributable to the rental period, plus any administrative cost we actually incur.

We will explain any deduction and provide supporting information where available. If the cost of damage exceeds the deposit, you remain responsible for the balance under the rental agreement and applicable law.

7. Cancellation, changes and refunds

You can request a cancellation from your customer portal where the booking supports it, or by contacting us. The cancellation takes effect when we acknowledge it, not when you send the request.

The refund you receive depends on how long remains before the rental start date. Our current schedule for paid bookings is:

  • 7 or more days before pickup: 100% of the rental amount is refunded.
  • 3 to 6 days before pickup: 50% of the rental amount is refunded.
  • 1 to 2 days before pickup: 25% of the rental amount is refunded.
  • Same day or after the pickup time: no rental refund.

The security deposit is refunded separately and in full, unless deductions under section 6 apply. If the booking has not been paid, there is no rental amount to refund; any unpaid balance is cancelled.

The same schedule applies when you ask to change your dates and the change cannot be accommodated, unless we agree otherwise in writing.

If we cancel because we cannot provide the booked vehicle, because the vehicle becomes unavailable, or because we cannot lawfully rent to you for a reason that is not your fault, we will offer a comparable alternative or refund the rental amount and deposit you paid. If we cancel at short notice for an operational reason, we will not keep a cancellation charge.

Refunds are made to the original payment method where possible, or by bank transfer for PromptPay payments. We aim to process approved refunds promptly, but bank processing times are outside our control. We may need reasonable proof of payment before refunding.

If you need to return the vehicle early, contact us before you do so. Any adjustment for unused rental days is handled under the rental agreement and applicable consumer law.

8. Collection and return

At pickup we will:

  • check your identity and licence documents;
  • ask you to sign or accept the rental agreement;
  • inspect the vehicle with you and record its condition, fuel level, mileage and included equipment;
  • explain the controls, any known quirks and our contact details for breakdowns or emergencies;
  • collect the rental payment and deposit if they are still outstanding.

Please inspect the bike carefully before you ride away and tell us about any existing damage or missing item. Photos taken at handover may be stored with the rental record.

You must return the vehicle:

  • on the date and time stated in the booking or rental agreement;
  • to the agreed location;
  • in the same condition as at pickup, allowing for normal wear;
  • with the fuel level stated in the rental agreement;
  • with all keys, helmets, documents and equipment provided.

If you will be late, contact us as soon as possible. A late return may incur the additional rental charge described in section 6 and may affect other customers' bookings. If you return the vehicle after the agreed time without contacting us, we may treat it as unauthorised use and take reasonable steps to recover it.

At return we inspect the vehicle with you where possible. We may take photos and record the condition, fuel and mileage. Any damage, missing item or charge is discussed with you and recorded before the deposit is settled.

9. Your responsibilities while riding

You must:

  • ride safely and lawfully, and comply with Thai traffic law;
  • wear a helmet where required and make sure any passenger does too;
  • carry the licence and documents required by law;
  • use the vehicle only for lawful personal transport;
  • keep the vehicle secure and take reasonable care of it;
  • check the vehicle before each ride, including tyres, brakes, lights and fuel;
  • stop riding and contact us if you notice a mechanical problem or warning sign;
  • report an accident, theft, damage or breakdown to us promptly;
  • return the vehicle at the agreed time.

You must not:

  • ride under the influence of alcohol, drugs or medication that affects your ability to ride;
  • race, stunt, off-road, or use the vehicle for any dangerous or unlawful purpose;
  • carry more passengers than the vehicle is designed or licensed for;
  • modify, repair or disassemble the vehicle without our permission;
  • use the vehicle to commit an offence or transport illegal goods;
  • sub-rent, lend or transfer the vehicle to an unlisted rider;
  • remove or alter the vehicle's registration plate, documents, tracking device or branding;
  • take the vehicle outside the area agreed in the rental agreement without our written consent.

Traffic fines, tolls and parking charges incurred during the rental are your responsibility. If we receive a fine or notice for the rental period, we may pass it to you and deduct our reasonable administrative cost from the deposit.

10. Accidents, damage and theft

If you are involved in an accident:

  1. Make sure everyone is safe and call emergency services on 1669 if anyone is injured.
  2. Notify the police where required and obtain a police report if possible.
  3. Contact us as soon as it is safe to do so.
  4. Do not admit liability to a third party and do not settle a claim without our agreement.
  5. Record the other party's details, vehicle registration, insurance information and photos of the scene if it is safe.

If the vehicle is damaged, stolen or involved in an incident, you must cooperate with our insurer, the police and any investigation, and provide the documents and information reasonably requested.

The rental agreement describes the liability cover included with your rental and any optional damage waiver. We do not promise comprehensive insurance or unlimited cover unless that is expressly stated in your rental agreement. You remain responsible for damage, loss or charges that are not covered, subject to applicable law and any mandatory consumer rights.

11. Our responsibilities

We will:

  • provide the vehicle described in your confirmed booking, or a comparable alternative we agree with you;
  • make sure the vehicle is roadworthy and has the required tax and registration for lawful use at the start of the rental;
  • disclose the rental price, deposit and additional charges before you confirm;
  • explain the main controls and provide contact details for help during the rental;
  • inspect the vehicle with you at pickup and return where practicable;
  • handle booking issues, complaints and refunds in good faith and within a reasonable time;
  • process your personal information as described in our Privacy Policy.

We do not guarantee that the website will always be available or error-free. We may suspend or change parts of the website for maintenance, security or operational reasons.

12. Accounts and website use

You are responsible for keeping your account credentials secure and for activity carried out through your account. Tell us promptly if you believe your account has been accessed without permission.

You must not:

  • attempt to access another customer's account, booking or personal information;
  • probe, scan or test the security of the website without written permission;
  • interfere with the website, its servers or other users;
  • use automated tools to scrape content, submit fake bookings or overload the service;
  • upload malware, unlawful content or misleading information;
  • impersonate another person or use a false identity to make a booking.

Guest checkout is available for customers who do not want to create an account. A guest booking is managed through the booking confirmation link and our support channels. Creating an account is optional and is not required to submit a booking.

13. Intellectual property

The ScooterExpress name, logo, website design, text, photographs, booking software and other content on this website are owned by us or used with permission. You may view and use the website for your own booking and rental purposes.

You may not copy, reproduce, modify, distribute, sell or use our branding or content for a commercial purpose without our written permission, except where the law allows it. Booking confirmations and invoices may be printed or saved for your own records.

14. Suspension and ending access

We may suspend or close an account or refuse a booking if:

  • you provide false, stolen or altered information or documents;
  • you attempt fraud, payment reversal or misuse of the booking system;
  • you breach these Terms or the rental agreement;
  • you use the website unlawfully or interfere with other users;
  • we are required to do so by law or a competent authority.

Where it is reasonable and lawful, we will tell you why access is being restricted and give you a chance to respond. We will not use suspension to avoid a legitimate refund or consumer right.

15. Liability

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Thai law, including liability for death or personal injury caused by our negligence, fraud, or any mandatory consumer right.

Subject to that:

  • we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our negligence;
  • we are not responsible for loss caused by your breach of these Terms, your failure to follow safety instructions, or events outside our reasonable control;
  • we are not responsible for indirect or consequential loss, such as lost profits, missed flights or lost holiday time, unless the law requires otherwise;
  • our total liability for a rental is limited to the amount you paid for that rental, except where the law provides otherwise or where the loss arises from our fraud or wilful misconduct.

You are responsible for damage, loss, fines and charges caused during the rental to the extent described in these Terms, the rental agreement and applicable law.

16. Governing law and disputes

These Terms are governed by the laws of Thailand. The courts of Thailand have jurisdiction, subject to any mandatory consumer protection rules that give you the right to bring a claim elsewhere.

If you have a complaint, contact us first using the details in section 18. Please include your booking reference, the dates of the rental and a clear description of the issue. We will try to resolve the matter promptly and fairly.

If we cannot resolve it together, either party may use the consumer dispute resolution process available under Thai law or bring a claim before the competent court. Nothing in this section prevents you from contacting a consumer protection authority.

17. Changes to these Terms

We may update these Terms when our services, prices, payment methods or legal obligations change. The version published on this page is the current version, and the effective date shows when it started to apply.

The version you accepted is recorded with your booking. A later version does not retrospectively change the terms of a completed rental. If you make a new booking after an update, the version in force at that time applies.
